CARELESS DRIVING – 6 DEMERIT POINTS
Section 130(1) of the Highway Traffic Act (HTA)
A conviction for careless driving:
Careless driving is a very common charge in the Province in Ontario. Usually, this charge is laid when an accident occurs. Every person who drives a vehicle on a highway without due care and attention or without reasonable consideration for other persons using the road is in contravention of s. 130(1) of the Highway Traffic Act. There are two charging streams for this offence: you can be charged with careless driving under a part 3 summons to appear or a regular part 1 traffic ticket.
As of 2020, the Ontario government has passed two new charges for Careless Driving:
- Careless driving causing bodily harm
- Careless driving causing death.
These charges are only laid when there is severe injury or fatality and carry harsher penalties.
Penalties for Careless Driving:
- A minimum fine of $400.00.
- A maximum fine is $2,000.00.
- Six (6) demerit points.
- If you are convicted, the court also can suspend your licence for up to two (2) years and imprisonment of up to six (6) months.
