Small Claims & Litigations

The Small Claims Court is a branch of the Ontario Superior Court of Justice. The monetary jurisdiction of the Ontario Small Claims Court is $35,000. These matters usually begin with a cause of action such as breach of contract (written or verbal) or negligence. For example, if you are owed money through a promissory note or perhaps you agreed on a service which was not satisfactorily or fully completed. You may be entitled to compensation. However, this compensation cannot exceed $35,000. If it does, you will be required to pursue legal action at the Superior Court of Justice. To “waive the excess” of your claim. Clients who “waive the excess” do so to take advantage of the Small Claims Court’s simplified procedures and lower filing fees. Should you choose to proceed with this option, you waive any future right to get this money in any other court.
