Section 136(1)(a) – Highway Traffic Act (HTA)

When a driver goes through a stop sign without stopping, they have committed an offence under the Highway Traffic Act. There are two common defenses for fighting a ticket for failing to stop at a stop sign or a marked stop line.
Under this section, a driver has a duty to yield the right of way at the intersection that they are approaching, and to stop for 3-5 seconds.
